Richard S. Cornfeld appointed to Executive Committee of Daily Fantasy Sports MDL

On March 31, 2016, Judge George A. O’Toole, Jr., of the District of Massachusetts appointed Rick Cornfeld to the plaintiffs’ Executive Committee of the Daily Fantasy Sports multi-district litigation.  Along with his co-counsel, the Bruning Law Firm, DeMoura|Smith LLP, and Perini-Hegarty & Associates, P.C., the Law Office of Richard S. Cornfeld brought two of the 86 cases against DraftKings, FanDuel and other defendants that were centralized before Judge O’Toole.

This MDL contains three distinct types of cases:  1)  Cases like those brought by this firm alleging “bonus fraud,” a scheme by which the fantasy sports companies falsely represent that participants’ first deposits of money will be immediately matched; 2) “insider trading” cases in which plaintiffs allege that employees used inside information to obtain an unfair advantage in the contests; and 3) “illegal gambling” cases in which plaintiffs allege that the defendants violated various state anti-gambling laws.  Mr. Cornfeld is the only one of the 13 attorneys appointed to a leadership position who brought a “bonus fraud” case.

In its Order, the Court found that Mr. Cornfeld and the other appointees “are able litigators who bring ample experience, knowledge, and resources to this complex litigation.”  The Court also found that Mr. Cornfeld and the other attorneys had “broad support among the plaintiffs’ attorneys as a whole ….”  Click here for a copy of the Court’s Order.
