A federal judge in the Western District of Missouri just denied an insurance company’s motion to dismiss in a lawsuit brought by a business seeking coverage for business income losses related to COVID-19.
The court recognized that “physical loss” as defined in the policy does not require physical damage to the insured’s property. It stated that “loss” is “the act of losing possession” or “deprivation.”
